摘 要
与贸易有关的知识产权协议的.产生，在促进知识产权国际保护发展的同时，也造成了知识产权制度与国际人权法之间的冲突。从立法宗旨上讲，不管对知识产权采用什么样的措辞，知识产权保护应与维护人类尊严和实现其他人权相1致。因此，我们必须开展有关研究工作，探寻如何在包括TRIPS在内的国际条约框架下，协调好知识产权与人权之间的冲突---价值连带和制度互动的问题。具体说来说，知识产权国际保护制度必须以国际人权公约的价值取向为指导，在保护公共健康权、隐私权等方面进行制度改革。

ABSTRACT
The emergence of TRIPS is thought to promote the international protection of intellectual property while engender the conflicts between intellectual property system and internatinal human rights law.From the tenet of legislation,regardless of any experssions being used to intellectual property, the protection of intellectual property should be accorded with the protection of human dignity and realization of other human rights.Consequently, we must develop related research work to search how to harmonize the relationship between intellectual property and human rights under the framework of international treaties included in TRIPS---the problem of related value and mutual system.In details,the system of international protection of intellectual property must make public health,privacy,etc. under the direction of the value orientation of international pacts concerning human rights.
